1) SELLER IDENTITY

2) SCOPE

These Terms and Conditions of Sale (T&Cs) govern, without restriction or reservation, all sales made by the Seller to any consumer via the Site. They prevail over any other document unless special conditions are expressly agreed in writing by the Seller. Acceptance of the T&Cs occurs when the order is confirmed (checkbox + double-click confirmation).

3) PRODUCT INFORMATION – REGULATED SECTOR

PoplarBio sells:

dietary supplements;

essential oils intended for aromatic and/or cosmetic uses as stated on each product page.

Mandatory statements for dietary supplements: not a substitute for a varied, balanced diet and a healthy lifestyle; do not exceed the stated daily dose; keep out of reach of children; not recommended for pregnant or breastfeeding women or for children, unless advised by a healthcare professional. If you are on medication, have a chronic condition, allergies or intolerances, seek medical advice.

Essential oils safety: unless otherwise stated on the product page, external use only; do not ingest; do not apply undiluted to skin (dilute in a carrier/vegetable oil); avoid eye area and sensitive zones; some essential oils (e.g., citrus) may be photosensitizing; do not use in pregnant/breastfeeding women, infants or young children, or in people with epilepsy or asthma without medical advice; carry out a patch test beforehand. Use away from sensitive animals and in well-ventilated rooms.

Photos and content are illustrative. The essential characteristics, directions for use, precautions and contraindications are specified on each product page and form part of the contract.

4) PRICES

Prices are shown in euros, VAT included, excluding shipping costs, which are displayed before checkout. PoplarBio may change prices at any time; the price due is the one shown at the time the order is confirmed. In the event of an obvious pricing error, the Seller may cancel the order and issue a full refund.

5) ORDER

Flow: cart → details → shipping → payment → confirmation. The Customer checks and corrects any errors before payment. The order becomes final only after the confirmation email is sent. The Seller reserves the right to refuse any abnormal order, an order placed in bad faith, or from a Customer with a serious prior dispute.

6) PAYMENT

Accepted methods: credit card (Visa/Mastercard).

7) DELIVERY

Service areas: the EU and any countries available in the Site’s country selector.

Fees: free shipping from €60 of purchases (unless otherwise stated). Below that threshold, fees are shown at checkout.

Timeframes: indicative, depending on carrier and destination; they do not include any customs formalities where applicable.

Transfer of risk: upon receipt by the Customer.

If a parcel is damaged or opened, the Customer must make specific reservations with the carrier and inform the Seller within 3 business days. Delays due to the carrier, customs, an incomplete address, or a force majeure event do not engage the Seller’s liability.

Outside the EU, any duties and taxes are payable by the Customer.

8) RIGHT OF WITHDRAWAL (DISTANCE SALES)

The Customer has 14 days from receipt to withdraw without giving any reason. The decision may be sent by email or via the form (Appendix 1). Products must be returned within 14 days of notification, new, unused, sealed where applicable, complete and in their original packaging.

Exceptions (French Consumer Code, art. L221-28) — no returns for:

goods unsealed for health protection or hygiene reasons (e.g., opened supplements, opened essential oils);

goods liable to deteriorate or expire rapidly;

digital content not supplied on a tangible medium once performance has begun with the express consent of the consumer;

services fully performed before the end of the withdrawal period, after express consent and waiver.

Refunds: all payments received, including standard delivery, are refunded within 14 days from the withdrawal decision (refund may be deferred until goods are recovered or proof of shipment is provided). Return shipping is at the Customer’s expense unless otherwise offered.

9) RETURNS – PROCEDURE

Contact support first: contact@poplarbio.com, stating the order number and product reference. Return address: 4 allée du Château, 64160 Bernadets, France. A RMA number may be provided by support before shipping.

10) STATUTORY WARRANTIES
10.1 Conformity (Consumer Code)

PoplarBio supplies a conforming good and is liable for lack of conformity appearing within 2 years of delivery. The Customer is entitled to bring the goods into conformity at no cost (repair/replacement); failing that, to a price reduction or rescission.

10.2 Hidden defects (Civil Code 1641 et seq.)

If a defect renders the goods unfit for their intended use, the Customer may choose rescission of the sale or a price reduction.

These statutory warranties apply independently of any commercial warranty.

11) USE – HEALTH ADVICE – DISCLAIMER

Information provided on the Site and products is informational and educational only and does not constitute medical advice, diagnosis, or treatment. It is not a substitute for consultation with a healthcare professional. The Customer remains solely responsible for assessing the compatibility of products with their personal situation (medications, medical history, allergies, pregnancy, etc.).

Limitation of liability (to the extent permitted by law): PoplarBio shall not be liable for indirect, non-material or consequential damages (loss of opportunity, data loss, reputational harm, etc.). For proven direct damages attributable to the Seller, total liability is limited to the VAT-inclusive amount paid by the Customer for the order concerned. Nothing herein excludes or limits the consumer’s statutory rights or liability for bodily injury or wilful misconduct/gross negligence.

The Seller accepts no liability for misuse contrary to instructions, failure to follow precautions (dosage, contraindications, dilutions), interactions with treatments, or use by non-recommended persons (minors, pregnant/breastfeeding women, listed conditions, etc.).

12) INTELLECTUAL PROPERTY

The Site and its contents (texts, visuals, trademarks) are protected. Any unauthorised reproduction is prohibited.

13) CUSTOMER SERVICE – COMPLAINTS – MEDIATION

After first contacting the Seller, the Customer may use consumer mediation free of charge. Consumer mediator: to be designated (details will be published on this page once the membership is completed). If unavailable, the Customer may use the EU ODR platform (https://ec.europa.eu/consumers/odr/).

14) PERSONAL DATA

See the Site’s Privacy Policy. The Customer has GDPR rights (access, rectification, erasure, objection, restriction, portability) via contact@poplarbio.com.

15) FORCE MAJEURE

Neither party is liable for failure due to an event of force majeure (e.g., pandemic, disaster, strike, administrative decision, network/server outage, customs hold).

16) GOVERNING LAW – DISPUTES

These T&Cs are governed by French law (subject to any more protective mandatory provisions of the consumer’s country of residence within the EU). French courts with jurisdiction will hear disputes, without prejudice to amicable resolution methods.

17) EVIDENCE – ARCHIVING

Computerised records (orders, invoices, communications) kept under reasonable security conditions constitute proof between the parties. Invoices are archived on a reliable and durable medium.

18) AMENDMENTS TO THE T&Cs

PoplarBio may amend the T&Cs at any time. The applicable version is the one in force on the order date.
